Privacy Policy.

This Privacy Policy explains how Beri Brands, Inc. ("Beri Brands," "we," "us," or "our") collects, uses, discloses, and protects information when you visit beribrands.com (the "Site"), submit a form, or otherwise contact us. It also describes the privacy rights available to California residents and how to exercise them. By using the Site, you agree to the practices described in this Policy.

1. Information We Collect

We collect the following categories of information:

Information you provide to us

When you submit a contact form, request an audit or review, email us, or call us, we collect the information you choose to provide. This may include your name, email address, phone number, company or website, and the contents of your message or inquiry.

Information collected automatically

When you visit the Site, we and our third-party partners automatically collect certain information through cookies, pixels, tags, and similar technologies. This may include your IP address, device identifiers, browser type and settings, operating system, referring and exit pages, the pages and content you view, links and buttons you click, the dates and times of your visits, approximate geolocation derived from your IP address, and other usage and diagnostic data.

Information from third parties

We may receive information about you from advertising platforms, analytics providers, and social media networks (such as Meta and Google), including aggregated campaign-performance data and, where you interact with our ads, limited information about those interactions.

We do not intentionally collect sensitive personal information (such as Social Security numbers, financial account details, precise geolocation, health information, or information revealing racial or ethnic origin, religious beliefs, or sexual orientation) through the Site. Please do not submit sensitive information to us through web forms or email.

2. Cookies, Pixels & Tracking Technologies

We use cookies and similar technologies to operate the Site, understand how it is used, and deliver and measure advertising.

Cookies

Cookies are small text files stored on your device. We use both first-party cookies (set by us) and third-party cookies (set by our partners). Some are strictly necessary for the Site to function; others are used for analytics and advertising.

Pixels, tags, and web beacons

These are small pieces of code or invisible images that record activity such as page views and conversions and allow information to be shared with advertising and analytics partners. The technologies we may use include:

  • Meta Pixel (Facebook and Instagram).Operated by Meta Platforms, Inc., the Meta Pixel lets us measure the effectiveness of advertising on Facebook and Instagram, understand the actions visitors take on our Site, build and target custom and lookalike audiences, and deliver remarketing ads. It may collect information such as your IP address, browser and device data, pages visited, and button or form interactions, and Meta may match this information to a Facebook or Instagram account where one exists. Meta's handling of this data is governed by Meta's Privacy Policy.
  • Google services.We may use Google Analytics to understand Site usage, Google Ads conversion tracking and remarketing tags to measure and optimize advertising, Google Tag Manager to manage tags, and Google Maps. These services may collect device and usage data and set cookies or identifiers, governed by Google's Privacy Policy.
  • LinkedIn Insight Tag. Operated by LinkedIn Corporation, this tag enables campaign reporting and the delivery of ads to LinkedIn members, and may collect IP address, device and browser characteristics, and page activity.
  • Other analytics and advertising technologies that we may add from time to time to measure performance and deliver relevant advertising.

Managing cookies and tracking.Most browsers let you refuse or delete cookies through their settings, and you can usually reset your device's advertising identifier. Blocking some cookies may affect how the Site functions. See "Advertising Choices & Opt-Outs" below for additional controls, and "Your California Privacy Rights" for opt-out rights that apply to certain tracking.

3. How We Use Your Information

We use the information we collect to:

  • respond to your inquiries, provide requested audits or proposals, and communicate with you about our services;
  • operate, maintain, secure, and improve the Site and our services;
  • analyze Site traffic, usage, and trends, and measure the performance of our content and marketing;
  • deliver, target, personalize, and measure advertising, including remarketing to visitors across Meta, Google, LinkedIn, and other platforms;
  • detect, prevent, and address fraud, security incidents, and technical issues;
  • comply with legal obligations and enforce our terms and agreements; and
  • fulfill any other purpose disclosed to you at the time we collect the information, or with your consent.

4. How We Share & Disclose Information

We do not sell your personal information for money. We may share information as follows:

  • Service providers. With vendors who perform services on our behalf, such as website hosting, form and email delivery, customer-relationship management, and analytics. They are permitted to use the information only to provide services to us.
  • Advertising and analytics partners. With partners such as Meta, Google, and LinkedIn in connection with the cookies, pixels, and tags described above, to measure and deliver advertising. Depending on the technology and your settings, these disclosures may involve the use of your information for cross-context behavioral advertising.
  • Legal and safety. When we believe disclosure is necessary to comply with law, legal process, or government requests; to enforce our agreements; or to protect the rights, property, or safety of Beri Brands, our clients, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, in which case information may be transferred as part of the transaction.
  • With your consent or at your direction.

A note on "selling" and "sharing." Although we do not sell personal information for money, the use of advertising cookies, pixels, and tags (such as the Meta Pixel and Google and LinkedIn tags) to deliver cross-context behavioral advertising may be considered a "sale" or "sharing" of personal information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), and under certain other state laws. California residents may opt out as described below.

5. Advertising Choices & Opt-Outs

You have several ways to control advertising and tracking:

  • Global Privacy Control (GPC). We honor the Global Privacy Control signal. When we detect a GPC signal from your browser or device, we treat it as a valid request to opt out of the sale or sharing of personal information for that browser or device.
  • Platform controls. You can adjust your ad preferences directly with Meta (in your Facebook and Instagram ad settings), Google (through Google Ads Settings and the Google Analytics Opt-out Browser Add-on), and LinkedIn (in your LinkedIn ad settings).
  • Industry opt-out tools. You can opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org.
  • Browser and device controls. You can block or delete cookies in your browser settings and reset or limit your mobile advertising identifier.

Opt-out choices are specific to the browser and device on which you make them, and clearing your cookies may require you to opt out again.

6. Artificial Intelligence & Automated Processing

We use technology, including artificial intelligence and machine-learning tools, to operate our business, for example, to analyze marketing performance, optimize advertising campaigns and bidding, assist with content creation, and support customer communications. Advertising platforms such as Meta and Google also use automated systems and machine learning to deliver and optimize the ads we run.

We do not use automated processing to make decisions that produce legal or similarly significant effects about you without human involvement. Where we use third-party AI tools, we seek to use reputable providers and to limit the information shared with them to what is appropriate for the task. We do not knowingly provide the personal information you submit to publicly available, general-purpose AI models in a way that would make your information available to unrelated third parties.

7. Your California Privacy Rights (CCPA/CPRA)

This section applies to California residents and supplements the rest of this Policy, as required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act.

Sources. We collect this information directly from you, automatically through your use of the Site, and from advertising and analytics partners.

Purposes.We use this information for the business and commercial purposes described in "How We Use Your Information."

Categories of third parties. We may disclose the categories above to service providers, advertising and analytics partners (such as Meta, Google, and LinkedIn), and legal or governmental authorities, as described in this Policy.

Sale or sharing.We do not sell personal information for money. However, our use of advertising cookies, pixels, and tags may constitute "sharing" (and, under some interpretations, a "sale") of identifiers and internet activity for cross-context behavioral advertising. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Sensitive personal information. We do not use or disclose sensitive personal information for purposes that would give you a right to limit such use under the CCPA/CPRA.

Your rights

Subject to certain exceptions, California residents have the right to:

  • Know and access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties to whom we disclose it;
  • Delete personal information we have collected from you;
  • Correct inaccurate personal information we maintain about you;
  • Opt outof the sale or sharing of personal information, including for cross-context behavioral advertising ("Do Not Sell or Share My Personal Information");
  • Limit the use and disclosure of sensitive personal information, to the extent we use it for non-permitted purposes; and
  • Non-discrimination, you have the right not to receive discriminatory treatment for exercising your privacy rights.

How to exercise your rights

You may submit a request by emailing us at jason@beribrands.com or calling (818) 519-3501. To opt out of the sale or sharing of your personal information, you may email us, adjust the advertising controls described above, or use a Global Privacy Control signal, which we honor.

Verification and authorized agents. For access, deletion, or correction requests, we will take steps to verify your identity before responding, which may include asking you to confirm information we already have on file. You may use an authorized agent to submit a request on your behalf; we may require the agent to provide proof of authorization and may require you to verify your identity directly.

Timing. We will confirm receipt of your request within 10 business days and respond within 45 calendar days, with one additional 45-day extension where reasonably necessary, as permitted by law.

"Shine the Light."California Civil Code Section 1798.83 permits California residents to request information about our disclosure of personal information to third parties for those third parties' own direct-marketing purposes. We do not disclose personal information to third parties for their own direct-marketing purposes.

8. Other U.S. State Privacy Rights

Residents of certain other states (such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana, among others) may have similar rights to access, correct, delete, or obtain a copy of their personal information, and to opt out of targeted advertising and the sale of personal information. To exercise any such rights, contact us using the information in "Contact Us." We honor the Global Privacy Control signal as an opt-out of targeted advertising and sale where applicable.

9. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to respond to your inquiries and provide our services, and to comply with our legal, accounting, and reporting obligations. When information is no longer needed, we take reasonable steps to delete or de-identify it. Information collected through cookies and similar technologies is retained according to the retention periods set by us and our partners for those technologies.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet, and no method of electronic storage, is completely secure, and we cannot guarantee absolute security. You are responsible for keeping confidential any credentials you use.

11. Children's Privacy

The Site is intended for a general business audience and is not directed to children. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of consumers under 16, in each case without the consent required by law. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

12. Email & Text Messages

If you contact us or become a client, we may communicate with you by email, phone, or text message in connection with your inquiry or our services. You can opt out of marketing emails at any time by following the unsubscribe instructions in those emails, and you can opt out of text messages by replying STOP. We may still send transactional or service-related communications where appropriate. By providing your phone number, you consent to be contacted at that number regarding your inquiry; message and data rates may apply.

13. Data We Process for Clients

In providing marketing services, Beri Brands may process personal information on behalf of our clients, for example, when we manage advertising accounts, install tracking technologies, or handle leads collected through our clients' websites and campaigns. When we act as a service provider or processor in this way, we process that information under our agreements with the client and on their documented instructions, and the client's own privacy policy governs how that information is collected and used. This Privacy Policy applies to information we collect for our own purposes through beribrands.com.

14. Third-Party Links

The Site may contain links to third-party websites, platforms, and services that we do not control, including social-media profiles and our Google Business Profile. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.

15. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. If we make material changes, we will take additional steps to notify you where required by law. Your continued use of the Site after an update constitutes acceptance of the revised Policy.
